These Website Terms of Use (“Terms of Use”) govern your access to and use of the website located at bizon-tech.com, its subdomains, and the content, tools, configurators, benchmarks, accounts and other features made available through it (the “Site”), which are owned and operated by Technostore LLC, dba BIZON, 3005 Greene St, Hollywood, FL 33020, USA (“BIZON”, “we”, “us”). By accessing or using the Site you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Site. Purchases of products and services are governed by the BIZON Terms of Sale and the policies incorporated in them, which control over these Terms of Use in the event of a conflict concerning a purchase. Use of BIZON software is governed by the End User License Agreement.
The Site is intended for use by persons who are at least 18 years of age. You may create a customer account to save quotations, place orders, track orders and manage warranty and support requests. You agree to provide accurate, current and complete information, to keep your password confidential, and to notify us promptly of any unauthorized use of your account. You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms of Use, the Terms of Sale or the Export Controls and Sanctions Compliance Policy, or that we reasonably believe are being used for fraud, resale, diversion or abuse.
The online configurator, pricing and quotations generated on the Site are provided for your convenience. A quotation is an invitation to place an order and is subject to the Terms of Sale, including the validity period stated on it, order acceptance by BIZON, and the Export Controls and Sanctions Compliance Policy. Configurations generated by the Site are not a representation that a particular configuration is suitable for your workload or facilities; you are responsible for verifying that the selected system meets your requirements, and BIZON’s engineers are available to assist on request.
Benchmarks, performance comparisons, GPU rankings, buyer’s guides, blog posts, specifications, power and thermal figures and other technical content on the Site are provided for general information. They reflect the hardware, software versions, settings and workloads used at the time of testing, which may differ from yours, and may be changed or withdrawn without notice. Such content does not constitute a warranty, specification or promise of performance for any product you purchase, and should not be relied upon as the sole basis for a purchasing decision. Product images are illustrative; actual products may vary.
The Site and all of its content, including text, graphics, logos, photographs, benchmark data, software, page layouts and design, and the BIZON, BizonOS and Z-Hub names and logos, are owned by or licensed to BIZON and are protected by United States and international copyright, trademark and other intellectual property laws. Subject to these Terms of Use, BIZON grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site and to view, download and print pages for your personal or internal business purposes in connection with evaluating or purchasing BIZON products. You may not otherwise reproduce, distribute, modify, create derivative works of, publicly display, republish, frame, scrape or exploit any part of the Site or its content without BIZON’s prior written consent. NVIDIA, AMD, Intel and other third-party names and marks are the property of their respective owners and are used for identification only.
You agree not to: (a) use the Site in any way that violates applicable law, including export-control and sanctions laws; (b) use any robot, spider, scraper, crawler, automated script or other automated means to access the Site, or to copy, harvest or extract pricing, configurations, benchmark data, content or user information, except for search engines indexing publicly available pages in accordance with our robots.txt; (c) attempt to probe, scan, test the vulnerability of, or interfere with the security, integrity or performance of the Site or any related system, or circumvent any access controls; (d) impersonate any person or entity, misrepresent your affiliation, or provide false information in a quotation, order, account or compliance form; (e) use the Site to place orders for resale, export or diversion in violation of the Terms of Sale; (f) upload or transmit viruses, malicious code or unsolicited commercial communications; or (g) use the Site or its content to build a competing product or service, or to train machine-learning models on BIZON’s benchmark data or content without BIZON’s written consent.
The Site may allow you to post product reviews, ratings, comments and other content (“User Contributions”). You retain ownership of your User Contributions. By posting, you grant BIZON a worldwide, non-exclusive, royalty-free, perpetual, irrevocable and sublicensable license to use, reproduce, modify, adapt, publish, translate, display and distribute your User Contributions, in whole or in part, in any media, including in BIZON’s marketing, and to use the name you submit with them. You represent that you own or have the rights to your User Contributions, that they are accurate and reflect your own experience, that you have disclosed any material connection with BIZON (such as receiving a discount or free product in exchange for a review), and that they do not infringe any third party’s rights or contain unlawful, defamatory, obscene or confidential material. BIZON may, but is not obligated to, review, edit, decline to post or remove any User Contribution at its discretion. BIZON does not endorse and is not responsible for User Contributions.
The Site may contain links to third-party websites and services, including financing partners, manufacturers, software publishers and payment processors. BIZON does not control and is not responsible for their content, products, services or privacy practices, and a link does not imply endorsement. Your dealings with any third party are solely between you and that third party.
If you believe that content on the Site infringes your copyright, send a notice containing the information required by 17 U.S.C. § 512(c)(3) to our designated agent: Technostore LLC (dba BIZON), Attn: Copyright Agent, 3005 Greene St, Hollywood, FL 33020, USA, support@bizon-tech.com. We will respond to valid notices in accordance with the Digital Millennium Copyright Act.
THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. BIZON DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF VIRUSES, OR THAT ANY CONTENT, PRICING, AVAILABILITY INFORMATION, CONFIGURATION OR BENCHMARK IS ACCURATE, COMPLETE OR CURRENT. THIS SECTION DOES NOT LIMIT THE WARRANTIES EXPRESSLY GIVEN FOR PURCHASED PRODUCTS IN THE BIZON LIMITED WARRANTY.
TO THE FULLEST EXTENT PERMITTED BY LAW, BIZON AND ITS OFFICERS, EMPLOYEES, AGENTS AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BIZON’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE (AS DISTINCT FROM LIABILITY FOR PURCHASED PRODUCTS, WHICH IS GOVERNED BY THE TERMS OF SALE) SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). NOTHING IN THESE TERMS OF USE EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
You agree to indemnify, defend and hold harmless BIZON and its officers, employees, agents and suppliers from and against any claims, liabilities, damages, losses and expenses, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms of Use, your User Contributions, or your use of the Site in violation of applicable law or the rights of any third party.
These Terms of Use are governed by the laws of the State of Florida, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms of Use or the Site shall be brought exclusively in the state courts located in Broward County, Florida, or the United States District Court for the Southern District of Florida, and you consent to the personal jurisdiction and venue of those courts. TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY WAIVES ANY RIGHT TO A TRIAL BY JURY, AND ANY CLAIM MUST BE BROUGHT IN A PARTY’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING. The prevailing party in any action to enforce these Terms of Use is entitled to recover its costs and reasonable attorneys’ fees.
BIZON may modify these Terms of Use at any time by posting a revised version on the Site; your continued use of the Site after the posting constitutes acceptance of the revised terms. BIZON may suspend, restrict or discontinue the Site or any feature at any time without notice. If any provision of these Terms of Use is held invalid or unenforceable, the remaining provisions remain in full force and effect. BIZON’s failure to enforce any provision is not a waiver of that provision. You may not assign these Terms of Use; BIZON may assign them to an affiliate or successor. These Terms of Use, together with the Privacy Policy, the Terms of Sale (for purchases) and the EULA (for software), constitute the entire agreement between you and BIZON regarding the Site.
